A class action lawsuit in the United States District
Court for the Eastern District of Pennsylvania alleged that the following
manufacturers of oriented strand board ("OSB") conspired in violation of
federal antitrust law to restrict the supply of OSB structural panel products
and raise prices: Louisiana-Pacific Corporation ("Louisiana-Pacific"),
Weyerhaeuser Company ("Weyerhaeuser"), Georgia-Pacific LLC (f/k/a
Georgia-Pacific Corporation) ("GP"), Ainsworth Lumber Co. Ltd. ("Ainsworth"),
Potlatch Corporation ("Potlatch"), Norbord Industries Inc. ("Norbord"), Tolko
Industries Ltd. ("Tolko"), Grant Forest Products Inc. and Grant Forest Products
Sales Inc. ("Grant"), and J.M. Huber Corporation or Huber Engineered Woods LLC
("Huber") (collectively, the "Defendants").
This lawsuit claimed
that as a result of Defendants' alleged conduct, the prices
paid by persons and entities that purchased OSB structural
panel products directly from Defendants were higher than they
otherwise would have been. The lawsuit sought treble damages,
injunctive relief, attorneys' fees and costs from Defendants.
Defendants denied that their conduct was unlawful, and
the Court never resolved the merits of
Plaintiffs' claims, because all nine Defendants in this Class
Action have reached settlements with Plaintiffs, resulting in a
total settlement fund of $120,730,000.
An initial round of settlement checks was sent to Authorized Claimants in September 2010. Now by Order of Judge Paul S. Diamond of the United States District Court for the Eastern District of Pennsylvania, a second round of settlement checks, accounting for the remaining settlement funds, has been sent to Claimants that previously cashed their initial distribution settlement check. The second distribution checks were mailed on January 22, 2013.
