Tolko Settlement Class On April 22, 2008, a Notice was sent to the Tolko Settlement Class that described the terms of the Tolko Settlement. On September 22, 2008, a separate Notice was disseminated to Tolko Settlement Class Members describing the proposed Plan of Allocation, the request for attorneys' fees, and how to obtain proceeds from any of the settlements in this case. The Tolko Settlement affects persons and entities who purchased OSB structural panel products in the United States directly from any Defendant from June 1, 2002 to and including March 19, 2008. The Court previously entered a final order approving the Tolko Settlement, under which Tolko agreed to pay $4,325,000 for the benefit of the class. SUMMARY OF YOUR LEGAL RIGHTS AND OPTIONS UNDER THE TOLKO SETTLEMENT: File a Claim Form If you are a member of the Tolko Settlement Class, you may be eligible to receive a share of the proceeds from the Tolko Settlement. In order to obtain a share of the proceeds from the Tolko Settlement, you must submit a Claim Form. The Claim Form must be postmarked or submitted online by December 1, 2008 to be considered for distribution. Object DEADLINE HAS PASSED Hire Your own Lawyer If you are a member of the Tolko Settlement Class, you may, but are not required to, hire your own lawyer at your expense to advise you of your rights with respect to the Tolko Settlement, the proposed Plan of Allocation, and Class Counsel's request for an award of attorneys' fees, reimbursement of litigation expenses and incentive awards for class representatives. You have the right to enter an appearance in the lawsuit through your lawyer if you wish. Do Nothing If you are a member of the Tolko Settlement Class and do nothing, you will not receive proceeds from the Tolko Settlement. You must submit a Claim Form to obtain a share of the Tolko Settlement. Even if you do nothing, you will be bound by the Release and Discharge provisions contained in the Tolko Settlement.
